This policy explains how Kudzu Seeds Trading collects, uses, shares and protects personal information, and what your rights are. It is written to meet the requirements of the Data Privacy Act of 2012 (Republic Act No. 10173) and its Implementing Rules and Regulations.

1. Who we are, and our Data Protection Officer
Kudzu Seeds Trading is a Philippine agricultural supply company based in Davao City, registered with the Department of Trade and Industry under Certificate No. 3128519. We supply tropical cover crop seeds, soil conditioners and pest management products to plantations, cooperatives, government programmes, distributors and farmers. For the purposes of the Data Privacy Act, we are the Personal Information Controller for the information described in this policy.

Kudzu Seeds Trading is the Philippine sister company of Chemiseed Sdn. Bhd. in Malaysia. The two are independent sister companies, not a parent and subsidiary. Our Data Protection Officer serves both companies, which is why the contact address above is a Chemiseed one. Mail sent to it reaches the right person for Kudzu Seeds matters.
2. What we collect
Information you give us
Our website does not process payments and does not sell online. Everything is quoted. The information we hold is what you send us when you make an enquiry through one of our forms, by email, or on WhatsApp:
- Name
- Email address
- Phone or WhatsApp number
- Company or organisation, and your buyer type (for example plantation, cooperative, distributor, government)
- Country and delivery location
- Details of your requirement: species or product, estimated quantity, planting area, delivery timeline, and any notes you add
- How you found us
- Your email address alone, if you subscribe to our updates
We ask for business contact details. Please do not send us sensitive personal information, as defined in the Data Privacy Act, unless we have specifically asked for it and explained why.
Information collected automatically
When you visit the site, our platform and analytics tools record technical information such as IP address, browser and device type, pages viewed, referring page and approximate location. This is described in our Cookie Policy.
3. Why we process it, and our lawful basis
Section 12 of the Data Privacy Act requires a lawful basis for processing personal information. Ours are set out below.

Where we rely on consent, you may withdraw it at any time. Withdrawing consent does not affect processing carried out before you withdrew it, and it does not affect processing we carry out on another basis, such as keeping transaction records we are legally required to keep.
4. Who we share it with
We do not sell personal information. We share it only where it is necessary:
- Chemiseed Sdn. Bhd. (Malaysia), our sister company, where your enquiry concerns a product they manufacture or a market they serve, so that your enquiry can be answered properly
- Shopify, which hosts this website and processes information on our instructions
- Analytics providers, as described in the Cookie Policy
- Freight forwarders, couriers and customs brokers, where a shipment is arranged for you
- Government authorities, where required for export documentation, phytosanitary certification, or where we are legally obliged to disclose
- Professional advisers, such as accountants and lawyers, under confidentiality
Where a third party processes personal information on our behalf, we remain accountable for it and require appropriate safeguards, consistent with Section 21 of the Data Privacy Act.
5. Transfers outside the Philippines
Some of the parties above are located outside the Philippines. Our website platform stores data on servers abroad, our sister company is in Malaysia, and shipments to overseas buyers involve parties in the destination country. We remain responsible for personal information transferred to a third party for processing, whether that processing happens in the Philippines or elsewhere, and we take reasonable steps to ensure a comparable level of protection.
6. How long we keep it
We keep personal information only for as long as necessary for the purpose it was collected for, and no longer, in line with Section 11 of the Data Privacy Act. In practice that means:
- Enquiries that do not lead to an order are kept while the opportunity is live and for a reasonable period afterwards, then deleted or anonymised
- Customer and transaction records are kept for as long as our tax, accounting and regulatory obligations require
- Newsletter subscriptions are kept until you unsubscribe
7. How we protect it
We apply organisational, physical and technical measures appropriate to the information we hold. These include restricting access to staff who need it, using reputable service providers, securing our website with encryption in transit, and reviewing our practices when our systems or processes change.
No system is completely secure, and we do not claim otherwise. What we commit to is handling your information carefully and telling you promptly if something goes wrong.
8. Your rights
Under the Data Privacy Act you have the following rights over your personal information:
- To be informed that your personal information is being or will be processed, and why
- To access the information we hold about you, and details of how it is being processed
- To object to processing, including processing for direct marketing
- To rectification, so that inaccurate or incomplete information is corrected
- To erasure or blocking, where the information is incomplete, outdated, false, unlawfully obtained, or no longer necessary
- To data portability, to obtain a copy of your data in a commonly used electronic format
- To damages, where you suffer because of inaccurate, incomplete, outdated, false or unlawfully obtained use of your information
- To file a complaint with the National Privacy Commission
9. How to exercise your rights or complain
Email our Data Protection Officer at shaharil@chemiseed.com with the subject line "Data privacy request", and tell us what you want us to do. We may ask you to verify your identity before we act, so that we do not disclose your information to someone else.
We will acknowledge your request and respond within a reasonable period.
If you are not satisfied with how we handle your request, you may bring the matter to the National Privacy Commission. Their contact details and complaint procedure are published at privacy.gov.ph.
10. Security incidents
If a personal data breach occurs that is likely to give rise to a real risk of serious harm, we will notify the National Privacy Commission and the affected individuals within seventy-two hours of becoming aware of it, as the Data Privacy Act requires.
11. Children
Our products and this website are intended for businesses and adult buyers. We do not knowingly collect personal information from children. If you believe a child has given us personal information, contact our Data Protection Officer and we will delete it.
12. Changes to this policy
We may update this policy as our operations or the law change. The effective date at the top shows when it was last revised. Material changes will be signposted on this page.
