Refund policy

Kudzu Seeds Trading. Effective date: 11 October 2026.

We supply business buyers in bulk, on a written quotation. This policy explains what happens if something is wrong with an order. It should be read with our Terms of Service and Shipping Policy. If anything here conflicts with your quotation or a signed supply agreement, the quotation or agreement applies.

1. No change-of-mind returns

We do not accept change-of-mind returns of seed, soil conditioners, lures or any other goods we supply, for example because you ordered too much or no longer need them. Opened seed cannot be returned unless it is defective under section 3. Seed is a living product and its quality depends on how it has been stored and handled; once goods have left our control, we cannot resell them to another buyer with confidence.

Please check the product, quantity and delivery term on the quotation carefully before you accept it.

2. Cancelling an order before dispatch

Once we have confirmed an order, it can be changed or cancelled only with our written agreement. If we agree to cancel an order you have paid for, we refund the payment less any costs we have already incurred, such as packing, documents, inspections and freight bookings.

3. What you can claim for

You can claim if:

  • Shortage: you received less than the quantity on the packing list;
  • Damage in transit: goods were damaged or lost before risk passed to you under the delivery term (see our Shipping Policy). If the damage or loss happened after risk passed to you, your claim lies with the carrier or your insurer, and we will provide the documents you need to support it;
  • Wrong goods: you received a product, grade or pack size different from your confirmed order;
  • Quality defect: the goods do not match the description on the quotation or, for seed, the germination and purity test results for the lot, for example germination below the test result for that lot.

A laboratory germination result is not the same as establishment in the field. Poor field establishment caused by storage after delivery, sowing method, weather, pests or land preparation is not a quality defect.

4. Seed viability claims

Germination falls over time, and faster in heat and humidity, so we can investigate a claim that seed germinates below the test result for its lot only if:

  • you notify us within the time limit in section 5, and before the lot is sown;
  • the seed has been stored since delivery as set out in our Terms of Service: in a cool, dry, shaded and well-ventilated place, raised off the floor, away from fertilisers, chemicals, fuel and pests, with bags kept sealed or resealed;
  • you tell us how and where the seed has been stored since delivery;
  • you send any germination test you have run (who tested, method, date and number of seeds tested). To be comparable with our result, a test must follow the same method as the test results for the lot, including how hard seed is treated or counted;
  • a sealed sample of the same lot is kept for us or for an independent laboratory.

5. Time limits

  • Shortage, damage in transit or wrong goods: notify us in writing within 7 days of delivery or collection.
  • Quality defect, including seed viability: notify us in writing within 30 days of delivery or collection, and before the affected goods are sown or applied.

We may decline claims made after these time limits.

6. What to send with a claim

  • Your order or proforma invoice number.
  • The lot (batch) number from the bag labels.
  • Photographs of the goods, the packaging, the labels and, for damage, the pallet or container.
  • The packing list and the carrier's delivery document, with any damage or shortage noted on it.
  • For a quality claim: the storage details and any test results described in section 4.

7. Keep the goods and a sample

Until we close the claim, please:

  • keep the remaining goods in their original packaging, stored as described in our Terms of Service;
  • keep a sealed sample of the affected lot, which we may ask you to send to us or to a laboratory;
  • not sow, apply, mix or dispose of the disputed goods further, unless we agree in writing.

We keep a retained sample of each lot we supply. We compare your claim against it, and we may inspect the goods ourselves or ask an independent surveyor or laboratory to do so. Where the results are disputed, either party may ask for the retained sample to be retested by an independent laboratory agreed by both of us (for seed, a seed testing laboratory), and the party whose position the result does not support pays for that test.

8. How we put it right

After we have investigated, if we accept your claim we will, at our discretion:

  • replace the affected goods or ship the missing quantity; or
  • issue a credit note for the affected goods against a future order.

Where we sent the wrong goods, short-shipped, or accept a quality claim, we pay the cost of delivering the replacement or missing quantity on the same delivery term as the original order. Our liability for any claim is limited to the price paid for the affected goods, as set out in our Terms of Service.

9. Returning goods

Goods may be returned only with our written authorisation and on the instructions we give, including the return address and who arranges and pays for the transport. We do not accept goods returned without authorisation. Where we ask for goods to be returned because our claim investigation needs it, or because we sent the wrong goods, we pay the return transport.

10. How to make a claim

  1. Email your claim, with the items in section 6, to the person who handled your quotation, or: buyers in the Philippines, info@kudzuseeds.com; buyers outside the Philippines, windhi@chemiseed.com.
  2. We reply within one business day (Philippine time) to acknowledge your claim and give you a claim reference.
  3. We investigate, which may include checking our retained sample, an inspection or a laboratory test, and tell you the outcome in writing.
  4. If we accept the claim, we replace the goods or issue a credit as set out in section 8.
